Drug users that have children often make mistakes that can result in imprisonment and more importantly – the loss of their child. Being caught in possession of drugs or trafficking of drugs has serious consequences by themselves, but if you have a child, the consequences may end up being unbearable.

Addiction causes irreversible problems

According to an article in WPTV News, a Lake Worth mother has admitted to being addicted to prescription medication and all because of her addiction has been charged with child neglect and physical abuse. She is being held without bond in the Palm Beach County jail.

Gina Marie Babecki, 30, has been accused of repeatedly overdosing her infant son on both his medication and her own, according to the article.

WPTV News also reported that Babecki had originally been bringing her son regularly to Bethesda Hospital since he was 4 months old. She claimed he was suffering from seizures. In August, 2010,  the boy (then 5 months old) was admitted to the hospital for a week.

After an interview with the staff, police determined that the staff never witnessed a seizure but after a few tests, they were able to detect prescription drugs in his system that were prescribed to his mother. Also, the staff found up to 10 times the prescribed amount of drugs from his own prescription in his system, according to the article.

When investigators interviewed Babecki, it was reported that she couldn’t recall some events in the previous days. She confessed to being addicted to prescription medications including anti-depressants, sleeping pills, and migraine medications.

She also admitted that she didn’t remember giving her child medication but that she cannot be one hundred percent positive that she did not give it to him, according to the arrest report.

Criminal Defense

If you have ever been charged with drug possession or drug trafficking, you need to immediately think about your family. If you are charged with a felony, you may lose your children. Keep that in mind when you decide to consult a criminal defense lawyer. Only a criminal defense lawyer can help you build your case and give you a chance to keep your children under your own protection.
