A recent court case has provided a framework for handling felony probation violations and keeping West Palm Beach probation violators out of jail. Recently, the 4th District Court of Appeals rendered an opinion that has profound and long lasting effects on how Violations of Probations ought to be dealt with, by criminal defense attorneys who handle Violations of Probation. Many times, probationers find themselves in violation of felony probation including terms of community control or house arrest for not completing a probationary requirement or for violating probation by committing a new crime. When probationers violate their probation, they are at the mercy of the “sentencing guidelines” as to what their possible sentence may be. The Independent Act: Co-Defendants Can Be Arrested, Charged and Convicted

In the State of Florida, co-defendants can be arrested, charged and convicted for the actions of their cohorts; even if one co-defendant knew of the elements of the criminal enterprise, but did not actually commit the crime itself. But isn’t it a defense in Florida to argue that the co-defendant who did not “know” of the plan to further the criminal episode is in fact protected by Florida’s “independent act doctrine.” The answer is yes, and more importantly was just written about extensively in an opinion from the 4th District Courts of Appeals that overturned Palm Beach Circuit Judge Stephen A. Rapp’s decision that condemn a woman for life. At the onset, there is nothing nice or good to say about Judge Rapp and in fact he has caused the… […]

Palm Beach County Animal Care and Control’s Animal Cruelty Investigations

Palm Beach County Animal Care and Control’s Animal Cruelty Investigations

As a practicing criminal defense lawyer and one who has built a reputation in animal law, I am writing this blog as a public announcement, as to behavior that I find very objectionable, regarding Palm Beach County Animal Care and Control. The mission of any Animal Care and Control Facility is to assure the public that unwanted domestic animals will be properly maintained during sheltering or re-homing, that the citizens of their locale will provide proof of rabies vaccinations to protect the public as a whole from the virus and to provide the public with the daunting task of euthanasia for those who cannot afford to use a private licensed veterinarian. As a matter of fact their slogan is “protecting the health, safety and welfare of animals and residents.” But… […]

DCF Involvement in Florida Criminal Cases

DCF Involvement in Florida Criminal Cases

As a criminal defense attorney, and also a family/criminal defense attorney who helps people with DCF cases, I many times find criminal cases intertwined with issues that involve intervention by the Department of Children and Families. DCF involvement in criminal cases is at an alarming rate, here in Florida. Alleged criminal activity of the defendant that has no nexus with his or her children many times become the target of DCF. Criminal defendants who have been arrested on drug related crimes, domestic battery accusations or find themselves facing incarceration often times also have a DCF matter to contend with. Florida law is clear on the termination of parental rights: “Termination of parental rights by the state requires clear and convincing evidence of: (1) a statutory ground for termination set forth in… […]
