Palm Beach Defense Attorney: DCF Has a Reputation for Breaking Up Families

According to criminal defense lawyer Andrew Stine, DCF has earned a reputation for using underhanded tactics to remove children from their homes. The Department of Children and Families (DCF) has a nefarious reputation throughout Florida for illegally removing children from their families, reports Andrew D. Stine, Palm Beach defense attorney. DCF will receive a report through the “hotline” regarding child abuse, child endangerment or child neglect and then use underhanded tactics in their investigation of the allegations. Several investigation tools used by DCF allow for the “child” to be interviewed, without the parents even knowing about the investigation let alone the interview. Schools are a favorite place for DCF to use this underhanded tactic in their bag of investigative tools. DCF likes to show up at elementary schools, middle schools… […]

Palm Beach Domestic Violence Lawyer: Responding Sheriffs Are There to Make an Arrest

When law enforcement arrives after a 911 domestic violence call, it’s not to act as marriage counselors or therapists. They are there to take someone to jail. In Palm Beach County, FL when a domestic disturbance is called into law enforcement officials through the 911 system or through the non-emergency number, police must respond, says Palm Beach domestic violence lawyer Andrew D. Stine. The Palm Beach County Sheriff’s Office is not responding to the domestic violence call in order to be a marriage counselor or family therapist. The deputy sheriff is responding to the domestic violence call to take someone to jail; and if children are present in the home, DCF will be notified by the responding officer. Palm Beach County has a “must arrest” policy on all domestic battery… […]

DCF Involvement in Florida Criminal Cases

DCF Involvement in Florida Criminal Cases

As a criminal defense attorney, and also a family/criminal defense attorney who helps people with DCF cases, I many times find criminal cases intertwined with issues that involve intervention by the Department of Children and Families. DCF involvement in criminal cases is at an alarming rate, here in Florida. Alleged criminal activity of the defendant that has no nexus with his or her children many times become the target of DCF. Criminal defendants who have been arrested on drug related crimes, domestic battery accusations or find themselves facing incarceration often times also have a DCF matter to contend with. Florida law is clear on the termination of parental rights: “Termination of parental rights by the state requires clear and convincing evidence of: (1) a statutory ground for termination set forth in… […]

Florida DCF Investigations into the Exploitation of the Elderly

Florida DCF Investigations into the Exploitation of the Elderly

In Florida, especially in South and Central Florida, the elderly have a dense population throughout our communities. We often read in the local paper or watch the nightly news with astonishment, when the coverage is about a story regarding an elderly person being swindled out of money, real property like a home or being duped out of home improvements, by an unscrupulous repair man or company. Florida General Statute 825.103, specifically articulates the legislature’s intent in attempting to keep the elderly safe from different forms of exploitation. In Florida,  a person is guilty of the exploitation of an elderly person or disabled adult when: (1) that person either stands in a position of trust and confidence, or has a business relationship, with the elderly person or disabled adult and knowingly,… […]

Criminal Charges Involving Florida’s Department of Children and Family Services (DCF)

Under Florida Law, criminal charges can also result in the Department of Children and Families being involved with the accused and their family. If children are present, during the serving of a search warrant of a home that yields illegal narcotics, then law enforcement officers serving the warrant must contact DCF. If an act of violence occurs in the home between the parents of the child, like a domestic battery, and the child is present, then DCF will be involved. If a parent or a “school teacher” with the latter being mandatory reporters, makes an allegation of child abuse, Law Enforcement Officials will response alongside of DCF. Remember, if DCF is involved in a family investigation, information the department receives from witnesses, including the accused, will be used against the… […]

An Overview of Florida’s Domestic Violence Laws

In Florida, the crime of Domestic Battery can be either a misdemeanor or a felony depending on whether or not the accused has a prior conviction for battery or the accused falls into one of the special crimes like domestic battery by strangulation. Domestic battery refers to the touching or striking of another person against that person’s will; with both individuals being family members, household members, in a dating relationship, in a romantic relationship. Simple battery occurs in Florida, when a person actually and intentionally touches or strikes another person against the will of the other or intentionally causes bodily harm to another person. Domestic battery compromises one of the prior battery elements; coupled with the “special relationship” element described in the prior paragraph, as between the parties. Simple battery… […]
