Aggressive enforcement against Palm Beach County pill mills has fueled heroin use and a spike in violent crime, reports criminal defense attorney Andrew Stine. Palm Beach County, Florida was recently known as the pill mill capital of the United States. But since the authorities, including the Federal Government through the DEA and the Palm Beach County Drug Task Force, led by the Office of the Palm Beach County Sheriff shut down the local pill mills, the need for addicts to get their fix on opium has not withered. As a matter of fact, over the past few years or since 2013, the rise of heroin on the streets of Palm Beach County, FL has escalated to epidemic levels. Drug Possession with Intent to Sell Versus Possession Charges

Drug Possession with Intent to Sell Versus Possession Charges

An appeal from the Fourth District Court of Appeals, for Palm Beach County, Florida demonstrates why; the argument of “personal use of drugs” ought to be made and argued by criminal defense lawyers in Palm Beach County Courtrooms when their clients face serious drug crimes.  Whether the accused is charged with cocaine, marijuana, heroin, methamphetamine or any other illegal drug listed under Fl. Stat. Sec. 893.13, the defense of ‘personal use” is available and worthy to be made during their jury trial. On Appeal, the defendant, Angelia Harris, argued she was denied due process in her conviction for possession of cocaine with intent to sell within 1,000 feet of a park. The defendant argued the trial court prevented her from arguing, at her jury trial, in front of Lucy Chernow… […]

Thermal Imaging by Palm Beach County Sheriff’s Helicopters to Bust Suspected Marijuana Grow Houses on the Rise

Thermal Imaging by Palm Beach County Sheriff’s Helicopters to Bust Suspected Marijuana Grow Houses on the Rise

As a practicing Palm Beach County Criminal lawyer, I have the opportunity to read search warrant affidavits on a regular basis. Recently, some affidavits that I have read, show an increase use of thermal imaging, by the Palm Beach County Sheriff’s helicopters, to detect suspected marijuana grow houses. The use of the Palm Beach County Sheriff’s helicopter can view the home through a thermal imager, a passive, non-intrusive device that measures heat in the infrared range. A thermal imager detects minute differences in temperature on the surface of objects and displays that information visually. The deputy sheriff can then determine though their training and expertise, whether or not the residency is emitting an inordinate amount of heat through its roof, floors or walls; with this information they can conclude that… […]

Marijuana Grow House Charges and Probable Cause

Marijuana grow house busts are on the rise throughout Palm Beach County, Florida as recently shown with several arrest of Lantana residents Raul Contreras Gonzalez, Luis Acosta and Victor Perez. Why such a spike in grow house busts by local, state and federal agents of those allegedly growing, cultivating and trafficking in weed throughout Palm Beach County, FL? One of the biggest reasons for the recent busts comes from the Palm Beach County Sheriff, Ric Bradshaw, who has made it his goal to have his deputies arrest all users, possessors and traffickers in marijuana. Another reason is the government’s role in not being able to tax illegal weed, in what it calls their crack down on drug policies. Because with every arrest for marijuana, comes a jail cell ran by… […]

Crystal Meth

Crystal Meth

Roving labs are set up in the back of pick-up trucks or vans and the drug is produced on the go.
