Palm Beach County Pain Clinic Overdoes Cases

Palm Beach County Pain Clinic Overdoes Cases

When Dr. Cynthia Cadet learned federal agents were raiding clinics where she had earned $1.2 million for 15 months of work, she called her boss to ask what was happening. “We were doing a service and we were paid to do it,” she told now imprisoned clinic owner Chris George in a conversation caught on tape by law enforcement officials. To her attorney, Cadet’s confusion about the March 2010 raids proves that she had no idea that her work, dispensing powerful narcotics to people who claimed they were in excruciating pain, was illegal. “She was doing a job,” attorney Michael Weinstein told a federal jury Thursday in closing statements. The prosecutor, Paul Schwartz, scoffed at the explanation. If Cadet was truly clueless, she would have been horrified, he said. He… […]

Unlawful Prescription of a Controlled Substance

Unlawful Prescription of a Controlled Substance

A Palm Beach County Circuit Court Judge ordered Barry Schultz can be released after posting $75,000 bond. ORIGINAL POST: A former Delray Beach-based doctor was arrested Tuesday on an allegation of overprescribing pain medication that resulted in the death of a patient, the Palm Beach County Sheriff’s Office said. Barry M. Schultz, 57, is facing charges of manslaughter and unlawful prescribing of a controlled substance. He was booked into the Palm Beach County Jail Tuesday evening and was being held without bail. Sheriff’s investigators alleged that Schultz overprescribed a lethal amount of the narcotic methadone to a patient. The patient, identified as David P. Tain, died in December 2010 after overdosing on pills that were provided by Schultz, the affidavit said. Schultz was arrested in March 2011 after deputies alleged… […]

Cracking Down on Drug Smuggling in the Caribbean

Cracking Down on Drug Smuggling in the Caribbean

MIAMI — Federal authorities have intercepted $35 million worth of cocaine from alleged smugglers in the Caribbean Sea. Source On Saturday, the U.S. Coast Guard offloaded 2,300 pounds of cocaine at their base in Miami Beach. Officials said they seized the drugs after an air crew spotted suspicious packages on a boat last week. Drug trafficking is the term used to describe the production, distribution and sale of illegal drugs. In the United States, such drugs include cocaine, heroin, PCP, LSD, methamphetamines and marijuana. Globally, drug trafficking is a multibillion dollar industry. As a profitable industry, illegal drug sales also fund the purchase of illegal weapons often used to fund organized crime and civil wars in developing countries. Even with stringent law enforcement efforts and penalties, authorities worldwide engage in… […]

Illegal Search and Seizure in Drug Cases

Illegal Search and Seizure in Drug Cases

A deputy responded to a store in the 100 block of North Federal Highway to investigate a reported disturbance. When he asked a woman involved in the incident for identification, she opened her purse to get her license. In plain site was an open pill bottle containing crack cocaine and two white pills, which were identified as Percocet. She was arrested and taken to the county jail. Source Law enforcement officers are entrusted with the power to conduct investigations, make arrests, perform searches and seizures of persons and their belongings, and occasionally use lethal force in the line of duty. But this power must be exercised within the boundaries of the law, and when police officers exceed those boundaries they jeopardize the admissibility of any evidence collected for prosecution. By… […]

Pill Mill Problem in Florida

Pill Mill Problem in Florida

Owning some of South Florida’s busiest pill mills was lucrative work and nothing held him back, Christopher George told a jury on Tuesday — not his complete lack of experience in the health care industry or even his criminal history as a convicted felon. “It brought in probably $40 million,” George said of the profits from the so-called pain management business in Broward and Palm Beach counties that he ran for three years. But there were hassles too and the main one was obvious to jurors as George — the star witness against two doctors accused of overprescribing pain pills and helping to cause the deaths of nine patients — testified Tuesday in federal court in West Palm Beach. The 32-year-old former Wellington man was handcuffed, shackled and is serving… […]

The Illegal Sale of Prescription Drugs

The Illegal Sale of Prescription Drugs

Due to their potential for abuse and addiction, many prescription drugs have been categorized by the US Drug Enforcement Administration in the same category as opium or cocaine. These include Ritalin and Dexedrine (stimulants), and the painkillers OxyContin, Demerol and Roxanol. Many illegal street drugs were at one time used or prescribed by doctors or psychiatrists but were later banned when the evidence of their harmful effects could no longer be ignored. Examples are heroin, cocaine, LSD, methamphetamine and Ecstasy. Abuse of prescription drugs can be even riskier than the abuse of illegally manufactured drugs. The high potency of some of the synthetic (man-made) drugs available as prescription drugs creates a high overdose risk. This is particularly true of OxyContin and similar painkillers, where overdose deaths more than doubled over… […]

Marijuana Grow Houses, Marijuana Legalization, Its Costs and Benefits Weighed

A Palm Beach Sheriff’s Office SWAT unit found a marijuana grow house at a home in suburban Delray Beach this morning, according to a PBSO spokesman. Police obtained a search warrant for a home at 15180 Monroe Road, where they found the marijuana plants. The home was unoccupied when police executed the search warrant. No arrests have been made, but the investigation is ongoing, said PBSO spokesman Eric Davis. (source) Colorado and Washington were the first two states to legalize recreational marijuana in last November’s election. However, what has happened in those states since the election? Have retail pot shops popped up on every corner? Are marijuana users smoking everywhere, or have federal raids dramatically increased? Hardly In Colorado, the immediate effect Amendment 64 has been the legalization of the… […]

Possession of a Controlled Substance, Drug Trafficking and Florida Pain Clinics

A 50-year-old man was arrested at Palm Beach International Airport this week after he allegedly tried going through security carrying hundreds of prescription pills he stole from his mother. Steven C. Kerner, of Selden, N.Y., was arrested at the airport around 8:15 p.m. Tuesday on several charges, including trafficking in hydrocodone and possession of a controlled substance without a prescription. Palm Beach County Sheriff’s deputies were called to the airport and spoke with Kerner. He told deputies that he stole the medicine from his mother, a Lake Worth resident, who takes the pills for “severe” medical conditions, according to a probable cause affidavit. Kerner said his mother was not aware that he took the pills from him and did not have a prescription for them. The bottles did not have… […]

A 32-year-old suburban West Palm Beach man is being accused of turning his home into a marijuana-manufacturing plant after authorities found almost 30 plants growing in three separate rooms. Alexei Garcia was arrested Friday on charges of manufacturing cannabis, trafficking in cannabis and possession of a dwelling to manufacture controlled substances. He was released Saturday after posting a $13,000 bond. The Palm Beach County Sheriff’s SWAT team executed a search warrant Friday at Garcia’s home in suburban West Palm Beach on Carambola Road north of Forest Hill Boulevard. Upon arriving at the home investigators noticed a “profuse odor or cannabis” outside, according to a sheriff’s probable cause affidavit.
