A judge has set a tentative trial date for the case against former tennis star Jennifer Capriati to be heard on Dec. 17. Capriati, who is charged with battery and stalking her ex-boyfriend in February, did not attend the brief hearing. Her attorney, Richard Lubin, was there and asked Judge August Bonavita for permission to depose the prosecution’s witnesses in the case. Capriati was charged in March with stalking and battery stemming from an alleged Valentine’s Day altercation with her ex-boyfriend at a North Palm Beach gym. ORIGINAL POST: A former Delray Beach-based doctor was arrested Tuesday on an allegation of overprescribing pain medication that resulted in the death of a patient, the Palm Beach County Sheriff’s Office said. Barry M. Schultz, 57, is facing charges of manslaughter and unlawful prescribing of a controlled substance. He was booked into the Palm Beach County Jail Tuesday evening and was being held without bail. Sheriff’s investigators alleged that Schultz overprescribed a lethal amount of the narcotic methadone to a patient. The patient, identified as David P. When he asked a woman involved in the incident for identification, she opened her purse to get her license. In plain site was an open pill bottle containing crack cocaine and two white pills, which were identified as Percocet. She was arrested and taken to the county jail. Authorities said today they charged 33 people and arrested 26 in a staged-accident ring in Palm Beach and Miami-Dade counties. Seven people are fugitives, including two alleged ringleaders that officials say have fled to Cuba. “Staged accident fraud has become the largest source of healthcare fraud in Palm Beach County,” said Marcus Christian, executive assistant U.S. Attorney for the Southern District of Florida. Sixteen of 21 chiropractic clinics involved are based in Palm Beach County. It’s the latest phase of a multi-agency operation that has been going on for more than three years and resulted in charges against 92 people.
